Terms of Purchase, Refund and Agreement Policy for Courageous Club

We are so happy you decided to consider purchasing a product or service from us here at Heather L Bunch (“us” or “Company”). Your joy and satisfaction is very important to us! These Terms of Purchase and Refund Policy apply to all purchases you make from us via our website, over the phone, at a live-event, or in any other manner.

Disclaimer:

All our educational and informational programs and services are aimed at helping you achieve certain results in your life or your business. However, we cannot and do not guarantee any specific outcome or that you will achieve any particular goal. In fact, we are providing our informational programs and services to you as just that: information. You are solely responsible for what you do with any of the information we provide and any outcomes that result. Furthermore, any testimonials of other students in our programs are no guarantee of your own success but simply are provided as examples of what others are doing.

No Warranties:  

THIS PROGRAM, AND INFORMATION PROVIDED IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, AND WE MAKE NO WARRANTY OF ANY KIND, IMPLIED OR EXPRESS, AS TO ITS ACCURACY, COMPLETENESS OR APPROPRIATENESS FOR ANY PURPOSE.

No Guarantees:  

We do not make any representations or guarantees as to the effectiveness, future income, expenses, sales volume or potential profitability that may be derived as a result of your going through this Program. Your success depends primarily on your own effort, motivation, commitment and follow-through. We cannot and do not guarantee that you will attain a particular business result or income increase or level through use of this Program, and you accept and understand that results differ by each individual based on your background, dedication, desire, and motivation, and many other factors. You agree that we are not responsible for the success or failure of your business decisions, the increase or decrease of your finances or income level, or any other result of any kind that you may have as a result of information presented to you through this Program. You are solely responsible for your results. You acknowledge and agree that no representation has been made by us or our affiliates and relied upon as to the future income, expenses, sales volume or potential profitability that may be derived from going through the Courageous Club program.

Refund Policy:  

It is my intention for you to be happy with your Courageous Club membership. Yet, because of the extensive time, effort, preparation and care that goes into creating and/or providing the Program, no refunds will be provided. Unless otherwise provided by law, you acknowledge that all sales are final and we do not offer refunds for any portion of your payment for any of the Program at any time. However, you can cancel your membership at any time knowing that you will forfete the price you intitally signed up for.

By signing up to join the Courageous Club, you agree that you will not issue a chargeback for any payment made as you are fully aware of this Refund Policy and voluntarily consenting to it. Should you attempt to issue a chargeback with your credit card company, this Agreement will automatically terminate upon such attempt, regardless of whether the attempt is successful or not, and you will still remain contractually responsible for that month’s payment. You agree that chargebacks are not permissible, and we reserve the right to report them.

Membership Fees:

If paying dues monthly, payment of the first month’s fees are due at the time of enrollment, and each subsequent fee payment is due and payable on a monthly basis from the date of enrollment. Payment may be made by credit card, PayPal or another payment app depending on what is available at the time of enrollment. If paying dues monthly, you agree that your monthly payment at the time of enrollment for as long was you are enrolled in the Courageous Club. Please be aware if you cancel your membership, and choose to enroll in the Courageous Club at a later date, you will be charged the going rate. If you use a third-party lender, even one suggested by us, you agree that you will perform your own due diligence and further acknowledge that we have no knowledge of any lender or offer any financial advice.

Authorization and Receipt:  

If paying by credit card, PayPal or ather payment app method, you give us permission to automatically charge your credit or debit card as payment for your Courageous Club membership for which you will receive an electronic receipt.  For monthly installment payments, you give us permission to automatically charge your credit or debit card at the time it is due without any additional authorization. Your billing and subscription information can be accessed in your client portal dashboard.

Missed Payment Policy:

Missed Payment:  We understand that there can be major life events or circumstances that prevent making payment on time, so we do allow you a 7-day grace period in which to make payment. However, if payment has not been received within that time frame, in our sole discretion, we reserve the right to stop your access to and participation in the Program immediately.

This Certification is not to be perceived as or relied upon in any way as medical advice or mental health advice. The information provided through this Courageous Club program is not intended to be a substitute for professional medical advice, diagnosis or treatment that can be provided by your or your client’s own physician, nurse practitioner, physician assistant, therapist, counselor, mental health practitioner, massage therapist, or any other licensed or registered health care professional. Do not disregard professional medical advice or delay seeking professional advice for yourself because of information you have received through this Program or from us in any other way. If you have or suspect that you have a medical or mental health issue, contact their health care provider promptly.  We are not providing health care, medical or nutrition therapy services or attempting to diagnose, treat, prevent or cure in any manner whatsoever any physical ailment, or any mental or emotional issue, disease or condition. We are not giving medical, psychological, or religious advice whatsoever.

CONFIDENTIALITY

The Company respects Member’s privacy and insists that Member respects the Company’s and Program Participants (herein referred to as “Members”). Thus, consider this a mutual non-disclosure agreement. Any Confidential Information shared by Program Members or any representative of the Company is confidential, Proprietary, and belongs solely and exclusively to the Participant who discloses it. Parties agree not to disclose, reveal or make use of any Confidential Information or any transactions, during discussions, on the forum or otherwise. Client agrees not to use such confidential information in any manner other than in discussion with other Members during Program. Confidential Information includes, but is not limited to, information disclosed in connection with this Agreement, and shall not include information rightfully obtained from a third party. Both Parties will keep Confidential Information in strictest confidence and shall use the best efforts to safeguard the Confidential Information and to protect it against disclosure, misuse, espionage, loss and theft. Member agrees not to violate the Company’s publicity or privacy rights. Furthermore Client will NOT reveal any information to a third party obtained in connection with this Agreement or Company’s direct or indirect dealings with Member including but not limited to; names, email addresses, third-party company titles or positions, phone numbers or addresses. Additionally, Heather L Bunch will not, at any time, either directly or indirectly, disclose confidential information to any third party. Further, by purchasing this product you agree that if you violate or display any likelihood of violating this session the Company and/or the other Program participant(s) will be entitled to injunctive relief to prohibit any such violations to protect against the harm of such violations.

NO TRANSFER OF INTELLECTUAL PROPERTY

Heather L Bunch’s program is copyrighted and original materials that have been provided to you, the Members, are for your individual use only and a single-user license. You (Member) are not authorized to use any of Company’s intellectual property for your business purposes. All intellectual property, including Company’s copyrighted program and/or course materials, shall remain the sole property of Heather L Bunch. No license to sell or distribute Company’s materials is granted or implied. By purchasing this product, Member agrees (1) not to infringe any copyright, patent, trademark, trade secret, or other intellectual property rights, (2) that any Confidential Information shared by the Company is confidential and proprietary, and belongs solely and exclusively to the Company, (3) Member agrees not to disclose such information to any other person or use it in any manner other than in discussion with the Company. Further, by purchasing this product, Member agrees that if Member violates, or displays any likelihood of violating, any of Member’s agreements contained in this paragraph, the Company will be entitled to injunctive relief to prohibit any such violations and to protect against the harm of such violations.

When You Buy from an Affiliate

We make no representations of any kind as to the products and services of any of our affiliates. Any purchase made through a third-party affiliate is subject to the affiliate’s own terms and conditions.

Name and Likeness Permission & Release

You agree if that if you attend an event live or online you give us permission to audio and video record and photograph you, and to use your name, likeness, audio, video, and photograph of you at the event for any purpose, in any manner, in any medium, now known or hereafter developed. You irrevocably grant to us the rights to use your name, likeness, and any audio/video recordings of you without further payment and without the ability to review the final product.

Force Majeure

We are not responsible for failure or delay of performance if caused by an act of God; hostility; telecommunication outage; government restrictions; a pandemic or other event outside of our reasonable control.
